Tax Deducted at Source (TDS) is a tax collection mechanism used by the Indian government to ensure the collection of taxes at the source of income. As a taxpayer or a deductor, it is essential to understand the TDS provisions and comply with them to avoid penalties and legal consequences. However, despite best efforts, mistakes can happen in TDS deductions, which can lead to incorrect or inadequate payment of tax. In such cases, TDS correction becomes necessary to avoid penalties and ensure timely and accurate tax compliance.

Common TDS Errors

  1. Incorrect TDS amount deduction
  2. Late payment or non-payment of TDS
  3. Non-filing or incorrect filing of TDS returns
  4. Incorrect PAN details
  5. Mismatch in TDS credit in Form 26AS and Form 16/16A

TDS Correction Procedures

TDS correction can be done through online and offline modes. The procedures for correction are:

  1. Online Correction: TDS correction can be done online through the TIN-NSDL website. The process involves submitting an online correction request by logging in to the website with the TAN and password details. Once the request is submitted, the TIN-NSDL team will process the request, and the correction statement will be made available for download.
  2. Offline Correction: TDS correction can also be done offline by submitting a correction statement to the Assessing Officer. The statement should be submitted in physical form along with the required documents and fees.

Penalties for Non-Compliance

Non-compliance with TDS provisions can result in penalties and legal consequences. Some of the penalties for non-compliance are:

  1. Late Payment: A penalty of 1.5% per month or part of the month is levied for late payment of TDS.
  2. Late Filing: A penalty of Rs. 200 per day is levied for late filing of TDS returns.

  4. Non-Filing: A penalty of Rs. 10,000 to Rs. 1,00,000 is levied for non-filing of TDS returns.
