The omission of Sections 12(8) and 13(9) from the IGST Act for export freight to transport goods outside of India, as announced in the Budget 2023-24, will have an impact.

The omission of Section 12(8) of the Integrated Goods and Service Tax (IGST) Act will have significant effects on the transportation of goods to a location outside of India. Prior to the omission, the following four points applied:

  1. Service recipient and service provider were both from India.
  2. Transfer of goods took place outside of India.
  3. The transaction was covered by certain regulations under Section 12(8) of the IGST Act.
  4. Even if the service recipient and service provider were registered in the same state, the place of supply was considered the goods’ destination “Other Territory,” and “IGST” was charged on the goods for transportation to a location outside India.

The effects of omitting Section 12(8) of the IGST Act are:

  1. The transportation of goods from India to a location outside the country will no longer attract IGST.
  2. Exporters will no longer need to pay IGST on export freight for goods transported to a location outside of India.
  3. The omission will reduce the cost of exporting goods from India, making Indian goods more competitive in the international market.
  4. This move will also facilitate the ease of doing business in India by reducing the compliance burden of exporters.

The omission of Section 13(9) of the Integrated Goods and Service Tax (IGST) Act will have significant effects on the transportation of goods to a location outside of India. Prior to the omission, the following four points applied:

  1. When either the service recipient or the service provider was located outside of India.
  2. Services for goods transportation, other than mail or courier, were provided.
  3. The transaction was covered under Section 13(9) of the IGST Act’s specific rules.
  4. The place of supply was regarded as the goods’ ‘Other Territory’ of destination, and GST was not applied to the goods for delivering the goods outside of India.

The effects of omitting Section 13(9) of the IGST Act are:

  1. Export freight for goods transportation, other than mail or courier, provided to an overseas recipient or provider will no longer be subject to GST.
  2. The omission will lead to a reduction in the compliance burden of taxpayers.
  3. The move will facilitate the ease of doing business in India and promote exports by reducing the cost of transportation of goods.
  4. Indian businesses involved in the export of goods will be more competitive in the global market due to the reduction in costs.
